1. Who we are

This service ("BIAS", the "Service") is provided by Mindful Trading AI ("we", "us", "our"). By creating an account or using the Service you ("you", "user") agree to these Terms & Conditions.

2. The service

BIAS is a trading journal and AI-assisted analytics tool. You log trades, your mood, and your discipline; we surface patterns and insights. The Service is provided as-is and we do not guarantee uninterrupted or error-free performance.

3. Not financial advice

Information, AI insights, scores and analytics provided by the Service are for general and educational purposes only. They are not financial, investment, legal or tax advice, and not a recommendation to buy or sell any instrument. All trading decisions are your sole responsibility.

4. Acceptable use

You agree not to misuse the Service, including: unlawful use, fraud, spam, infringing intellectual property rights, distributing malware, probing or attacking our infrastructure, or scraping. You are responsible for activity under your account and for keeping your credentials confidential. You must provide accurate information and be of legal age in your jurisdiction.

5. AI outputs

AI-generated insights may be inaccurate or incomplete. Do not rely on them without your own judgment. You are responsible for the prompts, notes and content you submit and must hold the rights to that content. We may filter, restrict or remove outputs that violate these Terms or applicable law, and we may suspend accounts that repeatedly do so.

6. Intellectual property

We retain ownership of the Service, including software, design, branding and documentation. You receive a limited, non-exclusive, non-transferable right to use the Service within your active plan. You may not reverse engineer, resell, redistribute or circumvent technical limits. You retain ownership of the trade data and notes you submit; you grant us a limited licence to host and process them solely to provide the Service.

7. Payments and subscriptions

Payments are processed by Stripe. By subscribing you agree to Stripe's terms in addition to these Terms.

Paid plans renew automatically at the end of each billing period until cancelled. You may cancel at any time from your account; access continues until the end of the paid period.

8. Suspension and termination

We may suspend or terminate your access for: material breach of these Terms, non-payment, security or fraud risk, or repeated/serious policy violations. On termination you may export your data within a reasonable window before deletion.

9. Warranty disclaimer & liability

To the fullest extent permitted by law, we disclaim all implied warranties (including merchantability and fitness for a particular purpose). Our aggregate liability is capped at the fees you paid us in the 12 months preceding the claim. We are not liable for indirect, consequential, special or incidental damages including loss of profits, data or goodwill. Nothing in these Terms excludes liability for fraud, death or personal injury where such exclusion is prohibited.

10. Indemnity

You will indemnify us against claims arising from your content, your unlawful use of the Service or your breach of these Terms.

11. Changes

We may update these Terms; material changes will be notified in-app or by email. Continued use after the effective date constitutes acceptance.

12. Governing law

These Terms are governed by the laws applicable at our principal place of business, without regard to conflict-of-law rules.
